PAYMENT AND REFUND TERMS

ACCOUNT INFORMATION
1. In order to undertake any payment for any Charge or invoice or Charge generated by IReservation (“Payment”), you must provide financial information as sought by the payment gateway system.
2. Any information used for the payment gateway shall be dealth in the manner as described in our privacy policy. If you provide account information for a debit or credit card to the Ireservation Platform via a third party, your provision of such debit or credit card shall also be subject to the terms and conditions specified by such third party. We take no responsibility and assumes no liability for any actions or omissions of such third party.
3. You may add, delete, and edit the payment method account information you have provided from time to time directly through the IReservation Platform. If you provide account information in such manner for more than one valid debit or credit card, you must select which debit or credit card you want to use to pay your Charges.
4. To the extent permitted by applicable law and subject to our privacy policy, you acknowledge and agree that we may use certain third-party vendors and Participating Merchants to process payments, manage debit and credit card information and detect and prevent fraud.
5. By providing debit or credit card account information through or to the IReservation Platform, you represent, warrant, and covenant that: (1) you are legally authorized to provide such information to us; (2) you are legally authorized to perform payments from the debit or credit card account(s); and (3) such action does not violate the terms and conditions applicable to your use of such debit or credit card account(s) or applicable law. When you authorize a payment using a debit or credit card account via the IReservation Platform, you represent, warrant, and covenant that there are sufficient funds or credit available to complete a payment using the debit or credit card account.
CHARGE AND PAYMENT
1. IReservation facilitates the collection, payment and settlement of reservation charges issued to you by a Participating Merchant ("Charge" ).
2. IReservation only facilitates the payment transactions by enabling you to make payments towards the Charges communicated by the Participating Merchant and does not provide any representation as to the accuracy or is responsible for any instance of overcharging or surge pricing undertaken by the Participating Merchant. It is clarified that the Charges in relation to a payment on the Platform is issued by the Participating Merchant to you for an underlying service offered by the Participating Merchant .
3. Any payment of Charge made on the IReservation Platform only absolves you of your responsibility or liability to pay to the Participating Merchant. Upon payment of Charge by the User, a confirmation will be generated. It is stated for clarity that a confirmation by IReservation that the payment of Charge only states that the amount has been deposited to the Participating Merchant and obligation to fulfil the reservation is that of the Participating Merchant.
PAYEMNT AND REFUND
1. You acknowledge and accept that any charge is final and shall not be liable for refund.
2. Ireservation reserves the right to charge any amount in the event of a Default User and No show. However, Any refund processed as a goodwill gesture will not accrue any right in present or furture to have any further right to refund.
3. In the event of cancellation by Participating Merchant, the Charge will be refunded to the wallet of the User.
4. While IReservation endeavours to have your Service Payment processed and settled in a timely manner, please note that there may be certain scenarios when the payment towards a Charge does not immediately reflect in the IReservation Platform. If for a particular Service Payment performed by you, money has been charged to your payment method however the payment towards the said Charge is not reflected with the Participating Merchant within three (3) working days of the completion of the Service Payment, then you may reach out to us for a confirmation on successful payment, through customercare@ireserved.com or directly to the concerned Participating Merchant, with the reference numbers and Service Payment details.
LIABILITY FOR CHARGE
1. IReservation reserves the right to charge, and recover from you, any fees or charges for availing Service Payments on the IReservation Platform. When and where applicable, these fees or charges shall be displayed on the IReservation Platform and will apply to you from the time they are posted on the IReservation Platform.

1. You agree to bear any and all applicable taxes and banking charges in connection with the Service Payment and the charges or fees that IReservation may levy.

1. IReservation may also send payment reminders to you for Service Payments that are due and payable to the Participating Merchant, provided however the non-receipt of any reminder from IReservation does not absolve you from your liability to make payments towards the Charge. If you wish to not receive such Service Payment reminders you can withdraw your consent by disabling such reminder notification from Account Settings or by clicking on unsubscribe link provided under such reminder notification. IReservation will not be responsible for any of your acts, including any non-payment of any Charge.

RESPONSIBILITY OF IRESERVATION
1. You agree and acknowledge that IReservation is only a facilitator and is not and will never be a party to or control in any manner any transactions with any Participating Merchant or those to which a Charge relates. IReservation is not a party (in any manner) to any arrangement between you and the Participating Merchant. IReservation never assumes any payment obligation in relation to the Service Payment, neither towards you nor towards a Participating Merchant.

1. Without prejudice to anything contained in these Terms, you agree that IReservation is:
  1. only a facilitator of Service Payments, i.e. the payments between you and the Participating Merchant for the services you avail from the Participating Merchant;
  2. not a party to Service Payment;
  3. not a payment system provider in relation to its role under these Terms;
  4. not responsible to you in any manner whatsoever, with respect to processing and settlement of payment relating to the Service Payments, as IReservation is only facilitating the Service Payment;
  5. not and will not be responsible for any aspect of the Service Payments;
  6. not a party to and will not be responsible for any disputes, chargebacks or reversals arising pursuant to the Service Payments, as IReservation is only facilitating the Service Payment; and
  7. not responsible for any of your acts, including, non-completion of a Service Payment or non-payment of any Charge.

DISCLAIMER:
1. Service Payments or any information in relation thereto is displayed and provided on the IReservation Platform on 'as is' and 'as available' basis without any representation or warranties, express or implied, to the maximum extent permitted by applicable law, unless otherwise specified in writing. IReservation disclaims all representations or warranties, express or implied, with respect to the offering of or availability of Service Payments, including without limitation, any express or implied representation or warranty of merchantability or fitness for a particular purpose. You agree and acknowledge that the use of Service Payments on the IReservation Platform is at your sole risk. Without prejudice to the foregoing, IReservation or its affiliates do not warrant that the services will meet your requirements or will be free of errors or deficiency.
2. IReservation shall not be liable / responsible for any defect in the services availed by you from a Participating Merchant and does not make any representation or warranties, express or implied, thereto. IReservation or its affiliates will not be liable, in any manner whatsoever, for any actions of a Participating Merchant or any loss caused to you due to any action of a Participating Merchant. IReservation shall not mediate or resolve any dispute or disagreement (including without limitation chargebacks or reversals) between you and the Participating Merchant or the sellers or merchants of the services.Except as specified under these Terms, IReservation is not and will not be responsible for any aspect of Service Payment.

1. You acknowledge that IReservation assumes no responsibility and shall incur no liability, if it is unable to affect the payments towards any Charge / Service Payment owing to any of the following circumstances:
  1. If the payment instruction issued by you is incomplete, inaccurate, invalid or delayed;
  2. If the payment account has insufficient funds or limits to cover for the amount of the payment instruction or the Charge;
  3. If the funds available in the payment account are under any encumbrance or charge;
  4. If your bank refuses or delays to honour the payment instruction for any reason;
  5. If Service Payment is not processed by the Participating Merchant; and
  6. If the Service Payment is not processed by the fulfiller in a timely manner.

LIMITATION OF LIABILITY:
1. IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN THE IRESERVATION PLATFORM'S CONDITIONS OF USE, IN NO EVENT WILL IRESERVATION OR ITS AFFILIATES OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO SERVICE PAYMENTS. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
TERMS OF USE
1. These Terms are in addition to the Terms of Use and shall be read conjointly with the terms of use. The Terms of Use shall also govern these terms for all matters of jurisidctions, waiver and other terms not expressly stated herein.
